Terms and Conditions
How to book
It is important that you follow all the booking directions and details
carefully. We will not be liable for your failure to do so. The person
who makes the booking is responsible for ensuring that the terms and
conditions are drawn to the attention of every person booked on the
Adventure Course / holiday.
Booking forms are to be sent by post including a cheque for 50% of the
course / holiday fee having received a detailed breakdown of the course
/ holiday.
Cancellation
or amendment - by you
If you withdraw from your Adventure course within six weeks of its start
date then you will be liable for the full cost of the holiday or course
fee. It is advisable to take out cancellation insurance for any holiday
booked in advance.
Transfer of
course / holiday - if you wish to transfer to a different course / holiday
within the same season, and provided there is space on the course /
holiday you wish to transfer to, no transfer fee will be applied. A
transfer made less than 14 days prior to the start of the course / holiday
will be classed as a cancellation unless we can re-fill the place.
Cancellation
or amendment - by us
We reserve the right to cancel any course / holiday if there are insufficient
bookings or we have an irresolvable staffing issue e.g. Illness/injury.
In the rare event of a holiday being cancelled you will be given one
of two options:
1. An option to
transfer to another course / holiday, in this instance no transfer fee
would be applied. If the new holiday fee is more than the original one
you will be requested to pay the difference, if it is less, you will
receive a full refund of the difference.
2. An option of
a full refund if you decide that no other course / holidays are suitable
for you at that time.
Prices
We reserve the right to change the prices at anytime before you book,
but you will be informed of any price change before you make a booking.
Once you have paid your deposit or full payment and we have confirmed
your booking we guarantee that your course / holiday will not be subject
to any increase in price.
Personal liability
insurance
It is mandatory to have sufficient personal insurance to cover yourself
whilst on a course / holiday and to cover cancellation due to sickness
or injury. We cannot accept responsibility for your luggage and personal
effects. It is your responsibility to care for and to fully insure all
equipment and personal possessions.
Your policy MUST cover the terrain and type of adventures you will be
participating in.
Problems not connected to our holiday package
If you should suffer illness, injury, or death through misadventure
arising out of an activity that does not form part of the course / holiday,
we cannot accept liability. We will, however be of assistance where
we can.
Our liability
We have exercised care in selecting providers of travel, accommodation
and other facilities. We accept no liability of services or facilities
provided by these third parties.
Your Safety
Whilst every effort is made to ensure your safety in the mountains you
must be aware that when participating in mountain activities there is
an element of risk. Your guide has the right to cancel or curtail your
participation on the course / holiday if she/he feels you are potentially
placing yourself or other members of the group at risk.
Your responsibility
When booking a course / holiday with us you undertake to conduct yourself
in an appropriate manner and not to disrupt the enjoyment of others
on the holiday or course. Anyone in defiance of this clause will have
their course / holiday terminated with immediate effect and we shall
hold no further responsibility to them.
Equipment loaned or hired
You will be accountable for any loss or damage to equipment loaned or
hired to you. The cost of repair or replacement will be left to the
discretion of Adventures Are Us staff.
Snow and weather conditions
We cannot accept responsibility for the snow or weather conditions.
In adverse conditions we will make every effort to provide a fun and
meaningful course / holiday.
Complaints
We hope that you will not experience any reason for complaint either
with administration and booking or on the course / holiday itself. If,
however you do have reason for complaint we ask that you take it up
with the most senior member of staff available as the problem arises,
so that we can attempt to solve it at once. We will not consider a complaint
unless it is made at the time of your course / holiday and put in writing
within 28 days of the end of your course / holiday
Information accuracy
Care has been taken to ensure that all information you have been given
either in writing or orally is to the best of our knowledge correct
at the time and given in good faith. However, there may be times when
an advertised facility or activity is either adapted or not available
due to, for example, adverse weather conditions or other reasons beyond
our control.
Legal challenges
In event of any dispute arising between us English law will govern any
litigation.
